The Personal Injury Roadmap

1. Newly Added

The path to recovery starts here. The potential new client contacts Chris Baldwin Law. This potential client is then added to Clio Grow. Once a free consultation is on the calendar, the matter is moved to Consult Scheduled.

2. Consult Scheduled

A free consultation is scheduled. The potential client meets with Chris Baldwin Law to discuss their case. After the free consultation, the personal injury intake is sent to the contact. Once the intake is received the matter is moved to Intake Received.

3. Intake Received

The potential client fills out the personal injury intake, which can be filled out online. This helps us evaluate the damages and causes of action. Once the intake is received, the matter is moved to Pending Review.


4. Pending Review

The case is reviewed by an attorney and discussed during an expert docket review if necessary. If we agree to move forward with the case, the matter is then moved to Pending Engagement.

5. Pending Engagement

A new client package is sent to the client. Once the new client package is sent or a meeting is scheduled, the matter is moved to Onboarding.

6. Onboarding

Once the potential client signs the contract, the case is moved from Clio Grow to Clio Manage. Reoccurring phone calls are scheduled to ensure the client is always up to date on the case.


7. Documents Requested

Medical records and bills are requested from either the potential client or the providers. A detailed subrogation is requested. Once all the pertinent records are received, the matter is moved to Investigation.

8. Investigation

All the records are organized and then reviewed by an attorney, and an expert if necessary. A detailed facts and theory document is created. The demand package is drafted.

9. Demand Package Sent

The demand package is finalized and sent to the defendant. The demand package outlines liability and provides a calculation of damages. Negotiations are now started and at any point the matter may move directly to Settlement.


10. Litigation Initiated

If the defendant does not settle within the permitted time allowed by the demand, a legal complaint is filed with the court. The matter is moved to Litigation Initiated when the legal complaint is filed.

11. Fact Discovery Started

Interrogatories (ROGs), Request for Admissions (RFAs), and Request for Production (RFP) are drafted and sent to opposing counsel. Party Depositions (Depos) are scheduled. We respond to defendant's discovery request.

12. Expert Depositions

Expert Depositions are taken. Any remaining discovery is completed. Discovery responses are organized and outlines of deposition transcripts are created. The matter is then moved to Settlement Conference.


13. Settlement Conference

A settlement conference and/or mediation is scheduled. This is to try, one last time, to reach a settlement before trial. If no settlement is reached, the matter is moved to Trial Prep.

14. Trial Prep

All the materials needed for trial are organized. A trial roadmap is created. The opening and closing statements are drafted. All witnesses are prepped for trial.

15. Trial

Jury Instructions. Voir Dior. Motions in Limine. Opening Statements. Plaintiff’s Case in Chief. Defendant’s Case in Chief. Closing Statements. Post Judgment Motions.


16. Settlement

The parties reach an agreement that ends the dispute and we voluntary dismiss the case. The matter is then moved to Disbursement. This step is skipped if settlement is never reached.

17. Disbursement

Using the funds received during the settlement, or as a result of trial, subrogation is paid, Chris Baldwin Law is paid, and the client is receives their recovery. The matter is then marked closed in Clio Manage.
